Terms of Service

Please read these Terms carefully before accessing or using our website, platforms, or programs. By accessing or using any part of our Services, you agree to be bound by these Terms. If you do not agree, do not access or use the Site.
1. OVERVIEW
The website located at www.yummiinguyen.com, and all content, services, and products available through that website and associated platforms — including Kajabi-hosted programs and any sub-domains — (collectively, the “Site”) are copyrighted works belonging to The Quantum Life Pty Ltd (ABN 87 633 874 647), represented by Yummii Nguyen (“The Quantum Life”, “we”, or “our”).
The Site provides users (“Users” or “you”) with educational materials, personal development frameworks, coaching programs, masterclasses, and recorded content developed from the proprietary methodologies of Yummii Nguyen.
Services are delivered via the Site and associated channels, including email, video content, live calls, Zoom sessions, Telegram group access, online programs, masterclasses, recorded transmissions, written materials, and digital downloads (collectively, the “Services”).
Certain programs may be subject to additional program-specific agreements (“Program Agreements”). Where any conflict exists between these Terms and a Program Agreement, the Program Agreement shall prevail.

2. INTELLECTUAL PROPERTY, TRADEMARKS & COPYRIGHT
2.1 Ownership
All intellectual property rights in the Site and its content — including copyrights, trademarks, trade secrets, frameworks, methodologies, recordings, written materials, visual assets, and digital programs — are owned by or licensed to The Quantum Life Pty Ltd. Nothing in these Terms transfers any such rights to you, except for the limited access licence in Section 3.
2.2 Registered & Pending Trademarks
The following names and phrases are proprietary trademarks of The Quantum Life Pty Ltd, registered or pending registration with IP Australia, and are protected under Australian and applicable international intellectual property law. Unauthorised use — including in any commercial or non-commercial context — may constitute infringement and give rise to legal action:

- Higher Self Mastery™
- The Quantum Life™
- Spiritual Business Ease™
- Awareness, Embodiment, Integration™
- Fields of Consciousness™
You may not use any of these marks, or any confusingly similar name, phrase, logo, or tagline in any context without prior written consent from The Quantum Life Pty Ltd.
2.3 Copyright-Protected Authored Works
The following original phrases, aphorisms, and expressions are authored original works of Yummii Nguyen and are protected by copyright under the Copyright Act 1968 (Cth) and applicable international copyright law from the date of their creation:

You may not reproduce, quote, publish, broadcast, or use these expressions in any commercial or public-facing context without prior written permission. Unauthorised reproduction — including on social media, websites, books, podcasts, or other programs — constitutes copyright infringement.
2.4 Proprietary Frameworks & Methodology
The following frameworks, methodologies, and bodies of work are the exclusive intellectual property of The Quantum Life Pty Ltd, along with all associated teachings, transmissions, and program architectures:
- Meet Fear, with Love™ framework
- Higher Self Mastery™ methodology
- The Finite and Infinite Self™
- Spiritual Business Ease™
- The Quantum Model of Love
- Fields of Consciousness™
You may not teach, reproduce, license, repackage, or create derivative works based on these frameworks or any content delivered through our programs — whether for commercial or non-commercial purposes — without prior written consent.
2.5 Testimonials
By providing a testimonial, you grant The Quantum Life Pty Ltd an irrevocable, worldwide, perpetual licence to use, publish, display, and reproduce your testimonial for any purpose, including advertising and promotion of programs, in any medium and without additional compensation. You waive any right to inspect or approve the final use of your testimonial.
Testimonials will only be used with identifying details (name, likeness, or direct quotes) with your prior written consent. Anonymised references to client experiences or transformations may be used without further consent.
2.6 Program Content & Recordings
All coaching call recordings, masterclass transmissions, written materials, learning resources, and digital content delivered through our programs are the exclusive property of The Quantum Life Pty Ltd, shared with you for personal use only. You may not:
- Download, copy, share, or distribute recordings or materials outside the designated program platform.
- Upload recordings or content to any external platform, including but not limited to ChatGPT, Claude AI, Gemini, Otter.ai, YouTube, or any AI transcription, summarisation, or repository service.
- Use program content for any commercial purpose, including teaching, speaking, creating your own programs, or training AI systems.
- Reproduce or recreate the structure, arc, or methodology of any program for your own offering.
Breach may result in immediate access termination without refund and may be subject to legal action, including injunctive relief and financial damages.
2.7 Non-Compete
You agree not to replicate, offer, or launch any program, container, course, or service that substantially mirrors the structure, methodology, or energetic arc of any The Quantum Life program for a period of 24 months following your participation, without prior written consent.
2.8 Liquidated Damages
In the event of a material breach of intellectual property terms, you agree to pay liquidated damages of $10,000 AUD per breach. This is a genuine pre-estimate of loss and is not a penalty. This does not limit The Quantum Life Pty Ltd’s right to seek additional damages where actual loss exceeds this amount.
3. LICENCE TO USE
Subject to these Terms, The Quantum Life Pty Ltd grants you a non-transferable, non-assignable, non-exclusive, revocable, limited licence to access the Site and program materials solely for your own personal use and for the purpose for which they were delivered.
This licence does not permit you to: (a) sublicense, sell, rent, lease, transfer, assign, or commercially exploit any Site content or program materials; (b) modify, create derivative works of, or reverse-engineer any part of the Site or its content; (c) access the Site or content to build a similar or competitive product or service; or (d) reproduce, distribute, publish, or transmit any content except as expressly permitted.
4. PROGRAMS & SERVICES
4.1 Current Offerings
The Quantum Life Pty Ltd currently offers the following programs, each governed by a Program Agreement in addition to these Terms:
- The Mastermind — Meet Fear, with Love™ (12-month high-level group container)
- Higher Self Mastery™ (private mentorship and group program)
- Spiritual Business Ease™ (private mentorship and group program)
- Fire Horse Intensive (private intensive coaching)
- Flight 369 — Quarterly Masterclass (experiential group container, offered four times per year)
- 7-Day Self-Forgiveness Challenge and other entry-level digital offers (as released)
Additional programs, masterclasses, intensives, and digital products may be offered from time to time. All such offerings are subject to these Terms and any applicable Program Agreement.
4.2 Refusal of Service
We reserve the right to refuse access to any program or Service, to any person or entity, at our sole discretion and without obligation to provide reasons.
4.3 Modification of Programs
We reserve the right to modify the structure, content, delivery, schedule, or format of any program at any time. Minor adjustments — including call scheduling, integration weeks, and platform changes — do not constitute a breach of agreement or grounds for refund.
5. FEES, PAYMENT & REFUND POLICY
5.1 Payment Obligations
All program fees are set out in the applicable Program Agreement. Payment of fees constitutes a full financial commitment to the program term, regardless of participation, completion, or withdrawal. Monthly payment plans are instalments of a full, non-cancellable commitment, not a cancellable subscription.
5.2 No Refunds on All Programs and Digital Products
All sales are final. No refunds are issued on any program, masterclass, self-paced course, digital download, workshop, challenge, or any other product or service offered by The Quantum Life Pty Ltd, except as required by applicable law.
This includes but is not limited to: The Mastermind, Higher Self Mastery™, Fire Horse Intensive, Flight 369, the 7-Day Self-Forgiveness Challenge, and all other current and future digital and live offerings.
The following are expressly not grounds for a refund:
- Change of mind
- Inability or failure to attend live calls
- Non-completion of the program
- Failure to achieve desired results or outcomes
- Personal circumstances arising after purchase
- Dissatisfaction with the content, style, or approach of the program
Where a refund request is made on grounds of non-delivery of advertised inclusions, it must be submitted in writing to hello@yummiinguyen.com within 30 days of program commencement, with specific evidence of the inclusions not delivered. All such requests are considered on a case-by-case basis and are not guaranteed. Refund requests submitted after 30 days will not be considered.
Upon receiving any approved refund, the Client agrees they will not be eligible to re-enrol in any programs offered by The Quantum Life Pty Ltd in the future.
Nothing in this section excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition, implied or imposed by the Australian Consumer Law, which cannot lawfully be excluded or limited.
5.3 No Guarantees
No specific outcomes — financial, emotional, relational, spiritual, or otherwise — are guaranteed through participation in any program, coaching session, masterclass, digital product, or service offered by The Quantum Life Pty Ltd.
Results depend entirely on your own choices, engagement, integration, capacity, and application of the work. Any results shared by the Coach or other participants — including testimonials, case studies, income figures, or transformation stories — are illustrative only and are not a representation, promise, or guarantee of similar results for you.
Your participation in our programs does not guarantee that you will achieve any particular transformation, healing, shift, or outcome. The depth of your experience is determined by you.
5.4 Payment Default
In the event of non-payment or late payment, The Quantum Life Pty Ltd reserves the right to: restrict or revoke access to all program content and platforms; retain all fees already paid; initiate collection proceedings including legal action; and recover all reasonable legal fees, recovery costs, and administrative expenses from the Client.
5.5 Chargebacks
Initiating a chargeback or payment reversal is a material breach of these Terms and any applicable Program Agreement. The Quantum Life Pty Ltd reserves the right to immediately revoke all access, pursue debt recovery, and seek damages including legal costs.
5.6 GST
A Goods and Services Tax (GST) of 10% applies to all purchases made by Australian residents, in addition to the stated program fee.
6. MEDICAL DISCLAIMER
The site and all services, programs, content, and communications offered by The Quantum Life Pty Ltd are not a substitute for professional medical advice, diagnosis, psychological treatment, or a professional therapeutic relationship.
Yummii Nguyen and The Quantum Life Pty Ltd are not licensed medical practitioners, psychologists, psychiatrists, or therapists. Coaching, mentoring, and spiritual guidance are distinct from — and do not replace — clinical or medical care. For legal purposes, coaching is an unregulated industry in Australia.
Nothing shared within any program, session, recording, written material, or communication by The Quantum Life Pty Ltd constitutes medical or psychological advice, diagnosis, or treatment. You are solely responsible for your health decisions.
If you are currently under the care of a medical or mental health professional, nothing in our programs should be construed as a recommendation to alter, reduce, or discontinue prescribed treatment or medication without consulting your healthcare provider.
If you experience emotional distress, psychological symptoms, or health concerns during or after participation in any program, you agree to promptly seek appropriate professional support. The Quantum Life Pty Ltd may recommend referral to a healthcare professional where it is deemed advisable.
If you believe you are experiencing a medical or psychiatric emergency, contact emergency services immediately (000 in Australia).
Participation in our programs may evoke emotional, energetic, or spiritual experiences. You take full responsibility for your wellbeing throughout and after your participation. The Quantum Life Pty Ltd shall not be held liable for any adverse physical, psychological, emotional, or spiritual outcomes arising from your participation.

7. LIVE SERVICES & SCHEDULING
Live session dates and times are determined at our sole discretion. Non-attendance does not give rise to any right of reimbursement or obligation to reschedule. Integration periods are not grounds for refund or program extension. Where the Coach must cancel a session, reasonable efforts will be made to reschedule.
8. TELEGRAM & COMMUNITY PLATFORMS
Community platforms (including Telegram) are peer-support spaces, not unlimited coaching channels. You agree not to solicit, recruit, or pitch services to other members. All community conversations are confidential. Misuse is grounds for immediate removal without refund.
9. CONFIDENTIALITY
All content shared within coaching sessions, Telegram groups, program portals, and community spaces is strictly confidential. You agree not to share, record, transcribe, screenshot, or republish any part of any session, call, or community dialogue. Anonymised learnings may be referenced by The Quantum Life Pty Ltd for teaching or marketing purposes, with no identifying details used without consent.
10. USER CONTENT
You are solely responsible for any content you submit to the Site or any program platform. By submitting content, you grant The Quantum Life Pty Ltd a non-exclusive, royalty-free, worldwide, irrevocable licence to use it in connection with the operation of our programs and platforms. Testimonial terms are set out in Section 2.5 above.
You agree not to submit content that infringes any third-party rights, is unlawful, defamatory, or misleading, or violates any applicable law or regulation.
11. USE OF ARTIFICIAL INTELLIGENCE
The Quantum Life Pty Ltd may use AI tools including Otter.ai and zoom ai for transcriptions, summaries and internal purposes. All reasonable steps are taken to anonymise personal information. You may not upload any program content, recordings, or materials to any AI platform or tool without prior written consent.
12. ASSUMPTION OF RISK
By participating in any program or Service, you acknowledge that transformation work involves emotional, energetic, and spiritual depth. You assume full responsibility for any experiences, responses, or triggers that may arise. You agree to self-resource and seek appropriate professional support as needed. The Quantum Life Pty Ltd shall not be held liable for any outcomes arising from your participation.
13. LIMITATION OF LIABILITY
To the fullest extent permitted by Australian law, The Quantum Life Pty Ltd’s total liability for any claim shall not exceed the total fees paid by you in the 12 months preceding the event. In no event shall The Quantum Life Pty Ltd be liable for any indirect, consequential, incidental, special, or punitive damages, including but not limited to emotional distress, loss of profit, or loss of business.
14. INDEMNITY
You agree to indemnify and hold harmless The Quantum Life Pty Ltd, Yummii Nguyen, and all affiliates, contractors, agents, successors, and assigns from any claims, losses, damages, and reasonable legal expenses arising from your use of the Site or Services, breach of these Terms, violation of any law, or your conduct within any program or community platform.
15. NON-DISPARAGEMENT
You agree not to make any defamatory, misleading, or damaging statements — publicly or privately — about The Quantum Life Pty Ltd, Yummii Nguyen, our programs, or our participants. Concerns are to be raised privately and respectfully. Breach may result in immediate removal and legal action.
16. PRIVACY
The collection and use of personal information is governed by our Privacy Policy at www.yummiinguyen.com/privacy-policy, incorporated into these Terms by reference.
17. THIRD PARTY CONTENT
The Site may contain links to third-party websites or services not under our control. Access is at your own risk. Third-party terms apply where applicable.
18. DISPUTE RESOLUTION
In the event of a dispute, parties agree to engage in: (1) Private Discussion; (2) Written Documentation; (3) Third-Party Mediation; (4) Legal Action — only if all prior steps fail. You agree not to engage in public complaint while resolution is underway.
19. GOVERNING LAW & AUSTRALIAN CONSUMER LAW
These Terms are governed by the laws of New South Wales, Australia. You submit to the exclusive jurisdiction of the courts of New South Wales. Nothing in these Terms excludes any right you may have under the Australian Consumer Law (Schedule 2, Competition and Consumer Act 2010 (Cth)).
20. GENERAL PROVISIONS
These Terms, with any applicable Program Agreement, constitute the entire agreement between you and The Quantum Life Pty Ltd. We may modify these Terms at any time; continued use constitutes acceptance. If any provision is found invalid, the remaining provisions continue in full force. You may not assign your rights without our consent. Headings are for convenience only. “Including” means “including without limitation”.
